The provisions of these Regulations are binding in the relations between the Client and the NAPRAWCZESC.PL Service and define the conditions and rules on which the company provides services to Clients.

                   

Any deviations from the Regulations or additional conditions shall apply only if previously agreed between the service provider and the client in writing, otherwise they shall be null and void.

  1. The data of every client are entered into the company's system using the form on the naprawczesc.pl website, which is filled in by the person or company commissioning the service. The Company has the right to access the content of the personal data and the ability to correct them.

The administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, provided by Service Users for the purpose of providing them with the services covered by these Regulations, is the company NAPRAWCZESC.PL Dawid Okoń. The Service Provider, as the controller of this data, ensures its security and, in particular, protects it against access by unauthorized persons.

All Service User data is collected and processed by the Service Provider for the purpose of proper provision of services in accordance with the regulations, particularly for the proper issuance of invoices, transfers, and the correct completion of declarations and documents for the purpose of the Service Provider's settlements with the Service User for the services provided.

The Service Provider may process, among others, the following personal data of Service Users: surname and name, company details for the proper issuance of invoices, registered address, and correspondence address. The Service User's electronic addresses, bank account number, and recordings of incoming and outgoing phone calls containing agreements between the client and the service provider.

  1. The company NAPRAWCZESC.PL provides services solely for the repair of the module regarding the specified fault. The parts listed in the offer are not subject to regeneration due to their structural design. The phrase "regeneration" appears on the website purely for marketing purposes. This term is used by clients due to unawareness or the misconception that certain parts can be regenerated.
  2. Before commissioning the repair, the client is obliged to contact the company by phone or email to confirm the offer.
  3.                        
  4. In case of ordering the service without prior checking of the offer, the service reserves the right to charge the client additional handling costs for the order.
  5.                        
  6. Commissioning the service or ordering a product is done via the naprawczesc.pl website by filling in the appropriate form. After placing an order, each client receives an individual order number that must be used for all correspondence.
  7.                        
  8. Sending a part for repair means acceptance of the regulations.
  9. Upon receiving a part for repair, the service assumes that the client has read and fully accepts the details of the offer.
  10. The Service contacts the client only in the case of repairs requiring non-standard solutions that would result in a change to the offer presented earlier.
  11. The repair time provided on the hotline and on the website is always estimated, and the actual repair time is always dependent on the type of part, the diagnosis made, and the volume of orders during a given period.

  13. Verification of the part is payable regardless of the diagnosis made.
  14.                        
  15. Diagnosis always involves interference with the part, which may result in a deterioration of its condition. The service provider is not responsible for the condition of the part if no repair is performed.
  16.                        
  17. In the case of repairs, the replaced components become the property of the repair service.
  18.                        
  19. Repair of modules that the service cannot test is considered completed when the client confirms that the module works correctly on their vehicle, provided that the vehicle in which the part is installed is fully functional.
  20.                        
  21. The Service is not responsible for the loss of programming data contained in damaged controllers.

Payments

                   

 

                   
                           
  1. Payment is made after the service is performed via courier using cash on delivery, however, this does not exclude the possibility of payment by bank transfer to the company's designated bank account.
  2.                        
  3. In case of necessity to send the part outside Poland, prepayment is required.
  4.                        
  5. In special cases, the Company may require a deposit payment for the service.

Warranties

                   

 

                   
                           
  1. The Company provides a warranty for the performed service only within the scope of the reported problem, which means it does not provide a warranty for the entire part.
  2.                        
  3. The Company does not provide a warranty for new software that has been uploaded.
  4.                        
  5. The warranty period depends on the type of service and the condition of the part.
  6.                        
  7. The warranty will be voided when:
  8.                        
                                 
    1. - warranty seals are broken
    2.                            
    3. - the part is installed in a vehicle with faulty electrical installation or damaged cooperating components
    4.                            
    5. - damage from a short circuit is found after opening the part
    6.                            
    7. - the casing is damaged or unsealed

                                 
    8. - the part is flooded (water damage)
    9.                        
                       
                   
                           
  1. The warranty for hydraulic parts will be voided when:
  2.                        
                                 
    1. - the part is installed on a contaminated hydraulic system
    2.                            
    3. - mechanical damage to the part is found
    4.                            
    5. - the part corrodes due to chemical agents or atmospheric conditions
    6.                            
    7. - the electric motor wears out or is flooded with liquid

                                 
    8. - the electric motor is damaged due to a controller fault
    9.                        
                       
                   
                           
  1. The Service is not liable for client losses caused by downtime resulting from the repair or warranty repairs.
  2.                        
  3. The Service is not responsible for and does not refund costs for the assembly/disassembly of parts or shipping costs.
  4.                    
                   

 

                   

Shipments and Returns

                   

 

                   
                           
  1. Particular attention must be paid to the part being sent so that it is properly packaged.
  2.                        
  3. Never send disassembled or incomplete parts.
  4.                        
  5. The order number for the service must be included inside the package.
  6.                        
  7. The service provider has the right to demand personal collection of the part in case of a high risk of damage during transport.
  8.                        
  9. The company has the right to dispose of the client's part if the client refuses to pay for the services rendered or if contact is broken for a period longer than 3 months.
  10.                        
  11. The cost of shipping the equipment back to the client is always borne by the client.
  12.                        
  13. In the event of the recipient failing to collect the shipment and the package returning to the service, the client bears the shipping cost for each subsequent return shipment.
  14.                        
  15. The service provider is not responsible for losses or damages resulting during the transport or shipment of the equipment.

Complaints

                   

 

                   
                           
  1. The Service User has the right to file a complaint regarding the performed service or product under the warranty, provided that the vehicle in which the part is installed has been thoroughly checked for existing faults.
  2.                        
  3. To consider any complaint, the Service User is obliged to send the part back to the service for verification and to enable its assessment and justification.
  4.                        
  5. The time for processing the complaint and for any repair or replacement of the equipment is 30 days from the moment the part is delivered to the company's premises.
  6.                        
  7. The Service has the right to eliminate the defect or replace the equipment with a fault-free one as a first step.
  8.                        
  9. In the event of a refund of repair costs, it is made within 14 days from the delivery of the appropriate documents to the company's premises, i.e.:

    5. - signed invoice correction (credit note)

  1. The refund is always made for the amount of the performed service or a part thereof and does not include the cost of courier shipments, part assembly/disassembly, etc.
  2.                        
  3. In the event of a serviceable part being returned for a complaint, the client bears the cost of the tests performed.
  4.                        
  5. The Service Provider, in the event of a request for repair and subsequent withdrawal from the contract during the repair process, is obliged to pay for the services fulfilled by the entrepreneur up to the moment of withdrawal. The payment amount is then calculated proportionally to the extent of the service fulfilled by the company, taking into account the price agreed in the contract.
  6.                        
  7. In accordance with Art. 38 of the Consumer Rights Act, the service does not accept the return of a controller programmed according to the client's specification only for a given vehicle.
  8. The return period for purchased products is 14 days from the date of purchase.

Final Provisions

                   

 

                   
                           
  1. In matters not regulated by these Regulations, the provisions of the Civil Code, as well as other generally applicable laws, shall apply.
  2.                        
  3. These regulations constitute an integral part of the concluded agreements.
  4.                        
  5. These regulations are effective from 26.07.2022.
